It is illegal to overstay your visa as it is a violation of immigration rules. Needless to say, you are also breaking the thai law. Overstaying is sanctioned under thai immigration procedures. Even if you overstay for just one day, legal actions could be taken up against your person. Usually though when you overstay for one day, it doesn’t carry a fine with it. The fine of 500 baht per day of overstay only begins after the second day, so if your stay expired on the 15th of March and you only reported to the immigration by the 20th, your fine will only be 4 days of overstay or 2,000 baht.

However, just avoid getting yourself caught by the immigration police at all means. If by any reason they will stop you in a random check-up on your way to the airport, they will imprison you regardless of the length of time you overstayed, even if it’s just one day! You’ll be confined in a jail until you can secure your flight outside Thailand or you can provide the money in payment for the fine. It remains a question though about you fixing things up when you’re actually inside the jail, in that case just keep hoping that some friend or lawyer might assist you through the ordeal. Amnesty International observed that thai jails are “cruel and degrading”, so as much as you can do not attempt to overstay in the first place.

Ich habe mir erlaubt die passende Stelle rot zu markieren. Wohlgemerkt geht es in dem Fall NICHT um die Situation bei Ausreise, sondern was per Gesetz passieren müsste falls man von der Polizei kontrolliert wird. Ob es so praktiziert wird steht auf einen anderen Blatt und ist pure Spekulation.



According to Ministry of Interior’s Order 1/2558 Regarding Classes of Aliens Ineligible for Admission to the Kingdom of Thailand

1. When entering the Kingdom of Thailand, please be mindful of the last day on your stay permit and DO NOT stay longer than the permitted date.
2. If you have already overstayed beyond the permitted date, you must leave the country before the order’s enforced date (20 March 2016).
3. If you have already overstayed beyond the permitted date and do not leave the country before the order’s enforced date (20 March 2016), you will be banned from re-entering the Kingdom of Thailand as shown in the details below:
   Alien Surrendered to Authorities:
   1. An alien who overstays more than 90 days beyond his/her permitted date will be banned from re-entering the country for 1 year, starting from the departure date.
   2. An alien who overstays more than 1 year beyond his/her permitted date will be banned from re-entering the country for 3 years, starting from the departure date.
   3. An alien who overstays more than 3 years beyond his/her permitted date will be banned from re-entering the country for 5 years, starting from the departure date.
   4. An alien who overstays more than 5 years beyond his/her permitted date will be banned from re-entering the country for 10 years, starting from the departure date.
      Alien Being Arrested and Prosecuted:
      1. An alien who is caught overstaying less than or exactly 1 year beyond his/her permitted date will be banned from re-entering the country for 5 years, starting from the departure date.
      2. An alien who is caught overstaying more than 1 year beyond his/her permitted date will be banned from re-entering the country for 10 years, starting from the departure date.
   
   
4. If you have already overstayed beyond your permitted date before the order’s enforced date (20 March 2016), you may surrender to the authorities at the Immigration Checkpoint (land border, seaport, and airport). You must pay a fine of 500/day, but not exceeding 20,000 baht before you are allowed to leave the Kingdom of Thailand.

... ja und selbst daß, was Du, in Englisch, zitierst begreifst Du anscheined nicht... "Usually though when you overstay for one day, it doesn’t carry a fine with it" ..... kleine Übersetzung, damit Du es ggf. doch noch begreifst:
"üblicherweise bringt eine längeres Bleiben von einem Tag keine Strafe mit sich"....

Und wenn du 5 Tage überziehst, zahlst du am Flughafen 2000 Bath. Also vier zahlen fünf bekommen..ist wie bei Lidl.

Aber das stimmt nicht. In so einem Fall zahlst du ab dem erstem Tag.

@bkk: Das ist von der Thai-Botschaft. Wie auch immer..ein Overstay von einem oder 2 Tagen ist doch nicht ein Verbrachen. Und das sehen die Thais wohl auch so. Ich bleibe bis zum letzten Tag und plane keinen "Puffer" ein.

2 Tage overstay kosten 1000 Bath - nicht 500 Bath, ich spreche aus eigener Erfahrung, bezahlt am Flughafen Phuket!

@bkk: Das ist von der Thai-Botschaft. Wie auch immer..ein Overstay von einem oder 2 Tagen ist doch nicht ein Verbrachen. Und das sehen die Thais wohl auch so. Ich bleibe bis zum letzten Tag und plane keinen "Puffer" ein.

Und du hast tatsächlich nur für 4 Tage zahlen müssen? Ich habe ab dem erstem Tag bezahlt, und das schon mehrmals.

Ich hab noch nie bezahlt. Aber das sagt die Thai-Botschaft in ihrem Artikel zum Thema auf ihrer Website.

Seltsam. Die gängige Praxis sieht anders aus. Ich weiß nicht wie oft ich schon Overstay hatte, aber gerechnet wurde immer ab dem erstem Tag. ( Ausser bei nur einem Tag).
Ist letztendlich auch egal, wegen 500 thb Differenz brauchen wir kein Fass aufmachen.
